They're not bound to that, though. It's not like WWE has to respect their own no-compete clause. Even if that had been their intention nothing's stopping them from bringing him back as soon as they want except for Danielson himself and a possible need to work around the independent dates he's booked.

I actually think Gabriel has better mic skills than he gets credit for. I would think in an absolute bind where they couldn't use Barrett or bring back Danielson they'd shift the center of attention to either Justin or Otunga. It certainly won't be Tarver or Sheffield, though I'd love to be wrong about that.
